- Funding -
LSED receives the bulk of its funding through the federal Older Americans Act, which is distributed to the New York State Office for the Aging and finally to the county Department of Senior Services. LSED contracts with several Western New York counties to provide legal services to the sixty and over population.
The single largest funder is the Erie County Department of Senior Services. In addition to Older Americans Act funds, Erie County provides additional support to LSED through its funding of our Grandparents Rights Project, the Medicare Maximization contract with the Department of Social Services, and our contract to act as court-appointed guardian for institutionalized, incapacitated seniors. |

Older Americans Act funding also is provided by the Cattaraugus County Department of the Aging, the Chautauqua County Office for the Aging, Allegany County Office for the Aging and the Seneca Nation of Indians. Each county Office for the Aging donates workspace, phones and equipment to our legal staff. These cooperative relationships allow us to provide quality legal services in an efficient, cost-effective manner.
In addition to Older Americans Act funding, several counties participate in the Medicare Advocacy Program (MAP), which has been conducted by LSED since 1988. Funded principally through the counties of Erie, Genesee and Niagara, MAP provides advice to and advocacy for Medicare recipients, with a goal of ensuring that medical coverage of benefits, prescribed by federal law are, in fact, extended to Western New York residents. Our advocates have represented clients at every phase of the appeal process, from administrative internal appeals and hearings up to federal court.
Since Medicare is the federal medical insurance program that provides primary coverage for individuals who are elderly, there is an additional benefit through our work in this area. By obtaining federal dollars to cover their health care, we delay or obviate the need for our clients to apply for state and county-funded Medicaid.
LSED is a charter member of the Interest on Lawyer Account Fund, a program dedicated to providing funds for civil legal services programs and programs for the improvement of the administration of justice. The IOLA funding is used to support our entire program with particular emphasis on the poor minority communities we serve. In 2006, 43% of our clients identified themsevles as belonging to a minority group.
Our local New York State Assembly Members and Senators have been instrumental this year in obtaining continued funding for our program. We have been fortunate to receive local initiative funding from both the Assembly Majority Democrats and Senate Majority Republicans, as well as a small budget line for civil legal services. This funding was critical in 2003, in that the IOLA Fund had to significantly reduce its available grant money, due to falling interest rates.
As always, private foundations and donations from individuals are of vital importance to a small, independent agency such as ours. In 2007, this source of revenue made up 15% of our budget, the second largest source of funds for the first time in our history. We would like to thank the following foundations for assisting us:
